In the vape market industry Elf Bar has made itself a household name, but things are changing for vape users in the U.S. Due to a copyright infringement lawsuit the name ELFBAR will be changed to EB DESIGN, but only in the states. Users outside of the U.S. will continue to see the name Elf Bar on their beloved vapes. Don’t worry ELFBAR is still the same just a change in name and slight subtle change in design.
The Lawsuit
The company that owns Elf Bar, Shenzhen IMiracle Technology Co. Ltd., is being sued by VPR Brands. The company based in Fort Lauderdale, Florida is claiming that IMiracle has created a trademark infringement, unfair competition and patent infringement against them. In other words, VPR is saying that they have the rights to the “Elf” brand in the U.S. and that IMiracle can’t use the name.
In recent updates the presiding judge on the case, District Court Judge Aileen M Cannon, granted VPR’s motion to a preliminary injunction which will prevent IMiracle from importing ELFBAR-branded devices and preventing Elf Bar master distributors from selling during the lawsuit.
New Design
You can see the new designs below due to the lawsuit. The disposable will now show the disposable’s iconic model number in a bigger sized font and the new company name in a small size just below. Whereas the old design was reversed, with the name Elf Bar significantly bigger than the model number displayed below it.
Note: The company’s other disposables will not be affected by this, i.e. Lost Mary and Funky Republic, the lawsuit is strictly directed towards the ELFBAR name. Comment below on your thoughts about the lawsuit.
